I. Your Relationship with Us and Acceptance of These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Vibera Digital Limited ("Company," "we," "us," or "our") governing your use of Vibera and all related services, features, content, and applications (collectively, the "Services" or "Platform").

By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Age Requirement: You must be at least 12 years old or the legal age of majority in your jurisdiction to use the Services. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the Services.

Arbitration Notice: These Terms contain an arbitration clause and class action waiver. By agreeing to these Terms, you agree to resolve disputes through binding individual arbitration rather than in court.

II. Amendments to the Terms

We may update, modify, or revise these Terms at our sole discretion at any time. Changes become effective when posted on the Platform. It is your responsibility to review these Terms periodically for updates.

Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Services immediately.

III. User Rights and Licenses

1. Right to Access the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial purposes.

Prohibited Activities: You agree NOT to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services
Use the Services for any commercial purpose without our express written consent
Extract, scrape, or harvest data from the Services using automated means (bots, scrapers, spiders)
Impersonate any person or entity, or falsely represent your affiliation with any person or entity
Harass, threaten, stalk, or abuse other users
Distribute viruses, malware, or any other harmful or destructive code
Attempt to gain unauthorized access to the Services, user accounts, or computer systems
Interfere with or disrupt the integrity or performance of the Services
Circumvent any content filtering, security measures, or access restrictions
Upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
Use the Services to violate any applicable local, national, or international law
Create multiple accounts for abusive or fraudulent purposes
Sell, rent, lease, or otherwise transfer your account or access to the Services
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Use the Services in any manner that could damage, disable, overburden, or impair our servers or networks

2. Application License

The license granted to you is conditional upon your compliance with these Terms. We reserve the right to revoke this license at any time if you violate these Terms or engage in conduct that is harmful to the Services, other users, or the Company.

IV. Indemnification

You agree to indemnify, defend, and hold harmless Vibera Digital Limited, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Your use or misuse of the Services
Your violation of these Terms
Your violation of any rights of another person or entity
Your violation of any applicable laws or regulations
Any content you submit, post, or transmit through the Services

V. Intellectual Property

All content, features, functionality, trademarks, service marks, logos, designs, text, graphics, images, software, and other materials included in the Services are owned by Vibera Digital Limited or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

No right, title, or interest in any content or intellectual property is transferred to you through your use of the Services. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Services or any content therein without our express written permission.

VI. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

The Services will be uninterrupted, secure, or error-free
The Services will meet your specific requirements or expectations
Any errors or defects in the Services will be corrected
The Services will be compatible with all devices, software, or systems

Your use of the Services is at your sole risk. We disclaim all liability for any harm resulting from your use of the Services.

VII. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBERA DIGITAL LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Services
Any unauthorized access to or use of our servers or any personal information stored therein
Any interruption or cessation of the Services
Any bugs, viruses, trojan horses, or similar harmful code transmitted through the Services
Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
Any conduct or content of any third party using the Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

VIII. Termination and Modification

We reserve the right to suspend, terminate, or restrict your access to the Services at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Extended periods of inactivity
Technical or security reasons

We may also modify, suspend, or discontinue the Services (or any part thereof) at any time without liability to you.

Upon termination, your license to use the Services will immediately cease, and you must stop using the Services and delete all copies of the application from your devices.

IX. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vibera Digital Limited regarding the Services and supersede all prior agreements, understandings, and communications.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Hong Kong for the resolution of any disputes.

Arbitration and Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration rather than in court, except where prohibited by law.

CLASS ACTION WAIVER: You agree that any arbitration or proceeding shall be conducted on an individual basis only and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms without restriction.

X. Subscriptions & In-App Purchases

If the Services offer optional premium features, subscriptions, or in-app purchases:

Subscriptions automatically renew unless you cancel them through your Application Store account settings before the end of the current subscription period
You will be charged through your Application Store account
Subscription management, billing, refunds, and cancellations are governed by the applicable Application Store's (Apple App Store, Google Play Store) terms and policies
We do not have access to or control over Application Store billing
All purchases are final and non-refundable except as required by law or the Application Store's refund policy
